Definition and Purpose of the Administrative Record File

The documents listed below make up the Vieques Administrative Records (AR) File. The AR is a collection of documents compiled by the US Navy, as represented by the Naval Facilities Engineering Command, to document the selection of environmental response actions for the Installation Restoration Program (IRP) currently underway at Vieques.

The AR File serves two purposes. First, it provides access to site-specific information so that the public may make informed comments to the US Navy on the selection of response actions. Second, if the adequacy of a response decision is challenged in court, the judicial review of that decision will be based on the documents in the AR File.  This file is consistent with the requirements of the Comprehensive Environmental Response  Compensation and Liability Action of 1980 (CERCLA), as amended by the Superfund Amendments and Reauthorization Action of 1986 (SARA). 

The AR File is important to the public because it contains information on which the selections of interim and final response actions for sites will be based. Technical studies and significant correspondence among local, state, and federal government agencies are included in the AR File, as well as those documents that reflect notification of and participation by the public in site activities.  The consideration given and response made by the Navy to public comments are also incorporated into the AR File.

Examples of information found in the AR File include sampling data, guidance and policy documents, technical studies, decision documents, proposed cleanup plans, correspondence, work plans, health/risk evaluations, public notices, public information materials, and court orders and decrees.

NAVFAC Atlantic welcomes comments at any time about Vieques environmental activities.  Formal comment periods are held at certain stages of the response process.  The public is urged to use these formal comment periods to submit comments on proposed actions. 

Location of Documents Available for Public Review and Comment

During the cleanup process at a military installation or Superfund site, certain documents are made available for public review and comment. The public is notified when and where such documents for Vieques can be reviewed, by publishing a notice in a local newspaper the week before a document is available for public review and comment, as well as posting the document electronically on the Vieques public website.

The Administrative Record documents are now available on a computer in the Electronic Library in Isabel Segunda, Vieques. That electronic Administrative Record will be updated periodically.
